Refugee & Asylum Lawyers in South Bound Brook, NJ

All asylum seekers must meet the definition of 'refugee' under the Immigration and Nationality Act, which includes persons outside of their country (and some persons who are still in their home country) who are unable or unwilling to return to that country because of persecution or a well-founded fear of persecution based on their race, religion, nationality, membership in a particular social group, or political opinion. Contact the asylum & refugee attorneys at Maverick & Peters, LLC to get expertise advice regarding your refugee & asylum situation. They are ready to provide assistance to families throughout South Bound Brook and New Jersey. Asylum seekers and refugees can gain legal residency status in the United States if they fulfill certain requirements under immigration law. The main differences between the two forms of relief are: asylum seekers are already on U.S. soil, while refugees are outside of the United States; and refugees seek help from the United Nations, while asylum applicants submit their petition to the U.S. government.

There are dangers of applicants being held in detention while their request is being considered, if they have entered the United States illegally. Immediate family members may also be eligible for asylum status, and will receive all of the benefits enjoyed by the asylum applicant, provided that those family members were named in the asylum application. Family members do not need to be present in the United States when the application is filed. If the refugee wishes to resettle in the United States, the U.N. will assist the applicant, and the U.S. government will review the refugee status claim before proceeding.

The Asylum Officer or Immigration Judge will either approve or deny the application and send a letter to the applicant informing him or her of the decision. Asylum and refugee lawyer, Vince Maverick, can help you navigate through this difficult and unfortunate time of your life. If you're going through a refugee & asylum in South Bound Brook NJ, give him a call today to see what options are available. Applicants have thirty-three days to appeal the denial of asylum, and instructions as to how to proceed with an appeal are included in the letter informing the applicant of the decision. The Board of Immigration Appeals in Washington, D.C. hears all appeals of asylum requests.

Asylum status may be terminated if the applicant no longer has a well-founded fear of persecution because of a fundamental change in circumstances, the applicant has obtained protection from another country, or the applicant has committed certain crimes or engaged in other activity that makes the applicant ineligible to retain asylum status in the United States. The applicant and his or her dependents who were included in the asylum decision are eligible to apply for work authorization during the background check process. To work in the U.S., the applicant and each qualifying family member must apply for and obtain an Employment Authorization Document (EAD). If authorized, the applicant may accept employment subject to any restrictions in the regulations or on the card. The applicant and his or her qualifying family members are not required to pay a fee with the initial requests for employment authorization. To obtain an EAD, the applicant must submit Form I-765, Application for Employment Authorization, to the appropriate USCIS Service Center. The applicant's asylum request will be considered (without additional refiling) when the applicant appears before an Immigration Judge at the date and time listed on the charging document the applicant will receive. The determinations that USCIS made in referring the applicant's application are not binding on the Immigration Judge, who will evaluate the applicant's claim anew. A referral includes the dependents included in the applicant's asylum application. For more information on this, contact the experienced asylum & refugee attorneys at Maverick & Peters, LLC today.
