Overtime & Wage Disputes Lawyers in Piscataway, NJ

The Fair Labor Standards Act (FLSA) regulates wages and hours in the workplace. It establishes a minimum wage and regulates overtime pay, record-keeping, and youth employment. The FLSA applies to employment in the private sector and to employment in federal, state, and local governments. Under the act, a workweek is 40 hours and federal minimum wage is $7.25 per hour (at July 24, 2009). The FLSA does not require an employer to offer vacation time, sick leave, or pay raises. Local and state wage and hour laws may also apply. Speak to a seasoned wage and overtime dispute lawyer, such as Vince Maverick, to discuss all your options when dealing with a overtime & wage dispute. He has assisted many families and individuals in Piscataway and throughout Middlesex County, NJ. The FLSA allows an employer can pay an employee that earns tips less than minimum wage if: the employee receives at least $30 a month in tips; the employer pays the employee at least $2.13 an hour in direct wages; the employer informs the employee of the arrangement in advance; and the combination of the employee's tips and direct wages equal at least the hourly minimum wage (if it does not, the employer must pay the employee the difference).

The FLSA requires that employers pay employees at least minimum wage and overtime pay equal to one-half of the employee's regular pay rate for hours that exceed a 40-hour workweek. However, FLSA regulations of minimum wage and overtime pay does not apply to exempt workers, including executives, administrative employees, professionals, computer specialists, and outside sales people. The computer specialist exemption applies if the worker: is employed as a computer systems analysts, computer programmer, software engineer, or a similarly skilled worker in the computer field; has the primary duty to: use system analysis techniques and procedures, which includes consultation with users to determine hardware, software, or system functional specifications; design, develop, document, analyze, create, test, or modify computer systems or programs, including prototypes, based on and relate to user or system design specifications; design, document, test, create, or modify computer programs related to machine operating systems; a combination of the duties; receives a salary of at least $455 per week or at least $27.63 an hour; and more. Other exempt workers include those employed by a seasonal or recreational business, causal babysitters, and newspaper delivery workers.

FLSA establishes minimum wage, overtime pay, recordkeeping, and child labor standards affecting full-time and part-time workers in the private sector and in Federal, State, and local governments. The Wage and Hour Division administers and enforces FLSA with respect to private employment, state and local government employment, and members of Congress and federal employees of U.S. Postal Service. Special rules apply to state and local government employment involving fire protection and law enforcement activities, volunteer services, and compensatory time off instead of cash overtime pay. Wage and overtime dispute lawyer, Vince Maverick, can help you navigate through this difficult and unfortunate time of your life. If you're going through a overtime & wage dispute in Piscataway NJ, give him a call today to see what options are available. Wages required by FLSA are due on the regular payday for the pay period covered. Deductions made from wages for such items as cash or merchandise shortages, employer-required uniforms, and tools of the trade, are not legal to the extent that they reduce the wages of employees below the minimum rate required by FLSA or reduce the amount of overtime pay due under FLSA.

While FLSA does set basic minimum wage and overtime pay standards and regulates the employment of minors, there are a number of employment practices which FLSA does not regulate. For example, FLSA does not require: vacation, holiday, severance, or sick pay; meal or rest periods, holidays off, or vacations; premium pay for weekend or holiday work; pay raises or fringe benefits; and a discharge notice, reason for discharge, or immediate payment of final wages to terminated employees. The FLSA does not provide wage payment or collection procedures for an employee's usual or promised wages or commissions in excess of those required by the FLSA. Some employees are exempt from the overtime pay provisions or both the minimum wage and overtime pay provisions. Some examples of exemptions include: executive, administrative, professional employees, farm workers, casual babysitters, seasonal amusement workers, small newspaper employees, seamen employed on foreign vessels, and much more.
