Piscataway | 08854For foreign individuals wishing to study in the U.S., being accepted into an American academic institution, language-training program, or vocational school that is approved by the United States Citizenship and Immigration Services (USCIS) is just the first step toward achieving your goal. The next step in the process is acquiring a student visa so that you can actually enter the United States. Contact student visa attorney, Vince Maverick, and the immigration lawyers at Maverick & Peters, LLC if you are concerned about student visa. They have advised many individuals in Piscataway and throughout Middlesex County NJ. A foreign national must have successfully completed the course of studies that are normally required for enrollment in the school or educational program. Unless the purpose for coming to the United States is to participate in an English language-training program, each applicant must demonstrate a command of the English language sufficient to handle the course of study. An exception to this requirement will be made if the educational institution has made special arrangements for the applicant to enroll in English classes, or if the classes will be taught in the applicant's native language. The 'J' visa is for educational and cultural exchange programs designated by the Department of State, Bureau of Consular Affairs. The 'J' exchange visitor program is designed to promote the interchange of persons, knowledge, and skills in the fields of education, arts, and sciences. 'J' exchange visitors include students at all academic levels; trainees obtaining on-the-job training with firms, institutions, and agencies; teachers of primary, secondary, and specialized schools; professors coming to teach or do research at institutions of higher learning; research scholars; professional trainees in the medical and allied fields; and international visitors coming for the purpose of traveling, observing, consulting, conducting research, training, sharing, or demonstrating specialized knowledge or skills, or participating in organized people-to-people programs. Participants in the 'J' exchange visitor program must have sufficient funds to cover all expenses, or funds must be provided by the sponsoring organization in the form of a scholarship or other stipend. 'Q' exchange visitors will be paid by their employing sponsor at the same rate paid to local domestic workers similarly employed. Exchange visitors coming under the 'J' program for graduate medical education or training must meet certain special requirements. Participants in the 'J' program must present a Form DS-2019 Certificate of Eligibility for Exchange Visitor (J-1) Status prepared by a designated sponsoring organization. Physicians coming to the United States on exchange visitor programs for the purpose of observation, consultation, teaching, or conducting research in which there is little or no patient care are not subject to special requirements. The CBP, not the Department of State Consular Officer, determines the period for which the bearer of an exchange visitor visa is authorized to stay in the United States. A beginning student who wants an earlier entry into the U.S. (more than 30 days prior to the course start date), must qualify for, and obtain a visitor visa. A prospective student notation will be shown on his/her visitor visa and the traveler will need to make the intent to study clear to the U.S. immigration inspector at port of entry. Before beginning any studies, he or she must obtain approval for a change to Exchange Visitor status, filing Form I-539, Application for Change of Nonimmigrant Status and pay the fee. Also you must submit the required Form I-20 to the Department of Homeland Security office where the application is made. Please be aware that one cannot begin studies until the change of classification is approved. Continuing students may apply for a new visa at any time, as long as they have been maintaining student status and their SEVIS records are current. Continuing students may also enter the U.S. at any time before their classes start. As part of the visa application process, an interview at the embassy consular section is required for visa applicants from age 14 through 79, with few exceptions. Persons age 13 and younger, and age 80 and older, generally do not require an interview, unless requested by embassy or consulate. Visitors who wish to stay beyond the date indicated on their Form I-94 are required to have approval by USCIS. Some nonimmigrant visa holders, while present in the U.S., are able to file a request which must be approved by USCIS to change to another nonimmigrant category. Filing a request with USCIS for approval of change of status before your authorized stay expires, while you remain in the U.S., does not by itself require the visa holder to apply for a new visa.
