Clark | 07066The visa most commonly thought of as the temporary work visa is the 'H' type, which has several classifications: H-1A; H-1B; and H-2. Speak to a seasoned work visa lawyer, such as Vince Maverick, to discuss all your options when dealing with a work visa. He has assisted many families and homeowners in Clark and throughout Middlesex County, NJ. The H-1A applies to registered nurses and responds to a shortage of persons in this field. Temporary visas in the H classification are subject to numerical limitations imposed by Congress, and that receipt of a visa is not a guarantee of immediate entry into the country. An employer must file a petition with the Department of Labor seeking labor certification before a foreign national can apply for a temporary worker visa. The employer must show that United States workers are not available to fill the position and that wages are working conditions meet regional standards. A single employer usually files this petition. An exception is made for agricultural producer associations, who are allowed to file as joint employers. There are annual caps on some types of temporary worker visas. H1B visa applicants must meet one of the following criteria: have completed a U.S. bachelorís or higher degree required by the specific specialty occupation from an accredited college or university; hold a foreign degree that is the equivalent to a U.S. bachelorís or higher degree in the specialty occupation; hold an unrestricted state license, registration, or certification which authorizes you to fully practice the specialty occupation and be engaged in that specialty in the state of intended employment; have education, training, or progressively responsible experience in the specialty that is equivalent to the completion of such a degree, and have recognition of expertise in the specialty through progressively responsible positions directly related to the specialty. Temporary work visas serve important purposes, allowing foreign nationals with valuable skills and knowledge to come to the U.S. to work, perform, entertain, and teach. The award of these visas depends on a number of parties fulfilling a number of requirements. Because the procedures and documentation required to secure a visa can be complicated and burdensome, the assistance of an experienced immigration attorney can help simplify the process and provide a better chance of visa approval. Several other visas also permit aliens to work temporarily in the United States: L-1 visa (intra-company transferees), O, P, and R visas also allow temporary employment in the U.S. The P visa applies to outstanding athletes, athletic teams and entertainment groups of sustained international recognition -- a prominent soccer team, for example. H1B visa application includes certain attestations, a violation of which can result in fines, bars on sponsoring nonimmigrant or immigrant petitions, and other sanctions to the employer. The application requires the employer to attest that it will comply with the following labor requirements: the employer will pay the beneficiary a wage which is no less than the wage paid to similarly qualified workers or, if greater, the prevailing wage for your position in the geographic area in which you will be working; the employer will provide working conditions that will not adversely affect other similarly employed workers. Notice of the filing of the labor condition application with the Department of Labor has been given to the union bargaining representative or has been posted at the place of business. There are some disadvantages to the 90-day Visa Waiver: there are no extension of stay past the 90 days and no change of status to another visa classification while inside the USA. One exception exists and that is to seek Permanent Residency/ green card status in the USA based upon a real marriage to a U.S. citizen. Otherwise, a business or pleasure visitor wanting to extend the stay or to change to a work visa must depart the USA, obtain a work-authorized visa on the passport page at a U.S. Consular Section or U.S. Embassy and then return to the USA.
